Terms of service
These terms govern your purchase and use of anything TheAifaLabs sells: downloadable study material, software subscriptions, research reports and custom services. Buying, downloading or using any of it means you accept them.

1. The agreement
These Terms of Service form a binding contract between you and TheAifaLabs. They apply alongside our privacy policy. If you are buying on behalf of an organisation, you confirm you have authority to bind that organisation, and "you" means the organisation.
Where we have signed a separate written agreement, statement of work or Data Processing Agreement with you, that document takes precedence over these terms to the extent of any conflict.
2. Definitions
- Digital Product — any downloadable file we sell, including CBSE, PMP and RMP study bundles and research reports.
- Subscription — recurring access to hosted software, including AifaSense plans and API access.
- Services — custom work delivered under a written proposal: web development, SEO, social media marketing, research sprints and retainers.
- Content — text, files, code, data, designs and media we supply as part of a Digital Product, Subscription or Service.
3. Eligibility and accounts
You must be at least 18 years old, or have a parent or guardian complete the purchase for you. Where a Subscription requires an account, you are responsible for keeping your credentials confidential and for all activity under your account. Tell us immediately at jhi@theaifalabs.com if you suspect unauthorised access.
4. Digital product purchases
4.1 Ordering and delivery
Prices are shown at checkout in the stated currency and include applicable taxes where indicated. Payment is taken by our payment processor at the time of order. Delivery of a Digital Product is by download link or account access, normally immediately and in all cases within 24 hours of cleared payment.
Some products are sold through Gumroad. Where that is the case, Gumroad handles the checkout, receipt and file delivery, and its own terms apply to that transaction in addition to these terms.
4.2 What you need to use the product
Study bundles are self-contained HTML files that run in a modern desktop or mobile browser. No internet connection is required for study once the files are downloaded, and progress is stored locally in your browser. You are responsible for having a compatible device and enough storage; we publish the requirements on each product page before purchase.
4.3 Pricing errors
If a product is listed at an obviously incorrect price because of a technical error, we may cancel the order and refund you in full rather than fulfil it. We will always tell you before cancelling.
5. Licence granted to you
On full payment we grant you a non-exclusive, non-transferable, worldwide licence to use the Digital Product for your own personal study or internal business use, for as long as the product remains usable.
You may: install the files on devices you own or control, print sections for your own study, and continue using the version you bought indefinitely.
You may not: resell, sublicense, rent, lend or redistribute the files; upload them to file-sharing sites, cloud drives shared with non-purchasers, coaching portals or LMS platforms; share your download link or account credentials; remove branding or copyright notices; or use the content to train a machine-learning model.
Institutional use — using a bundle with a class, batch or team requires a separate seat-based licence. Email jhi@theaifalabs.com for pricing. One personal licence never covers a cohort.
6. Refund policy
6.1 Digital products
Because a Digital Product is delivered instantly and cannot be returned once downloaded, all sales are final except in the circumstances below. By completing checkout you expressly request immediate delivery and acknowledge that, once the download has started, you lose any statutory right of withdrawal that would otherwise apply to distance sales of digital content in the EU and UK.
We will refund you in full where:
- the files are corrupt, incomplete, or will not open, and we cannot fix it within 5 business days of you reporting it;
- the product materially fails to match its description on this website;
- you were charged twice for the same order, or charged after cancelling; or
- you bought the wrong product and have not downloaded it, and you tell us within 14 days.
We will not refund because you changed your mind after downloading, because you did not use the material, or because an exam result did not meet your expectations.
6.2 How to request a refund
Email jhi@theaifalabs.com with your order ID and what went wrong. We respond within 2 business days and, where a refund is due, issue it to the original payment method within 10 business days. Purchases made through Gumroad are refunded through Gumroad.
6.3 Subscriptions
Cancel at any time; access continues to the end of the paid period and we do not refund part-months. If we materially reduce a plan's functionality mid-term, you may cancel and receive a pro-rata refund of the unused period.
6.4 Services
Deposits for custom Services are non-refundable once work has started, as they secure scheduled delivery capacity. Milestones already accepted are non-refundable. Unstarted milestones are refundable in full on written cancellation.
7. Subscriptions and renewals
- Subscriptions renew automatically at the end of each billing period until cancelled.
- We email a reminder at least 7 days before an annual renewal.
- Cancel from your account settings or by emailing support; cancellation takes effect at the end of the current period.
- Price changes are notified at least 30 days before they take effect and never apply to a period you have already paid for.
- Usage-based charges, such as API calls beyond the included tier, are billed in arrears on the next invoice.
- If payment fails we retry for 7 days, then suspend access. Data is retained for 90 days after suspension before deletion.
8. Custom services
Services are delivered under a written proposal that sets out scope, deliverables, timeline, price and assumptions. That proposal is part of this agreement.
- Change requests are quoted separately in writing; nothing outside the agreed scope is delivered or charged without your written approval.
- Your responsibilities — timely access, content, approvals and a named decision-maker. Delays caused by these move the timeline, not the price.
- Acceptance — deliverables are deemed accepted 10 business days after handover unless you raise a written defect within that period.
- Third-party costs — hosting, domains, licences, ad spend and stock assets are billed at cost and are yours to own and renew.
- Marketing outcomes — we commit to the agreed activity and reporting. We do not guarantee rankings, traffic, follower counts or revenue, since those depend on factors outside our control.
9. Intellectual property
9.1 What we keep
All Content in our Digital Products and Subscriptions — including text, question banks, explanations, diagrams, layouts, source code, the AifaSense platform, the TheAIFALabs name and logo — remains our property or that of our licensors. Buying a product buys a licence to use it, not ownership of it.
9.2 What transfers to you
For custom Services, on receipt of final payment we assign to you all rights in the bespoke deliverables created specifically for you — site code, designs, copy and datasets produced under the proposal. We retain ownership of our pre-existing tools, libraries, frameworks and internal methodology, and grant you a perpetual, royalty-free licence to use them as embedded in your deliverable.
9.3 Your material
You keep ownership of everything you give us. You grant us a limited licence to use it for the purpose of delivering the Services, and you confirm you have the rights to give it to us.
9.4 Portfolio rights
We may name you as a client and show non-confidential work in our portfolio, unless you tell us in writing not to. We never publish your data or anything marked confidential.
9.5 Third-party marks
PMP® and PMI-RMP® are registered marks of the Project Management Institute, Inc. CBSE is the Central Board of Secondary Education. TheAifaLabs is independent: not affiliated with, endorsed by, accredited by or authorised by PMI, CBSE or NCERT. Those marks are used only to describe what our material prepares you for.
9.6 Infringement reports
If you believe content on this site infringes your rights, email jhi@theaifalabs.com with identification of the work, the URL, and a statement of your good-faith belief. We act on valid notices promptly.
10. Acceptable use
You agree not to: reverse engineer or attempt to extract source from our products except where law permits; probe, scan or test the security of our systems without written permission; use the Services to send spam or unlawful content; scrape our site beyond ordinary browsing; resell access; or use our tools to process data you have no lawful basis to process. Automated access to the API must respect published rate limits.
11. Disclaimers
Educational material. Our study products are independent revision support. We do not guarantee any examination result, score, pass or certification outcome. Question banks and mock papers are our own composition or clearly labelled where sourced from public past papers; always check the current official syllabus, which is set by the relevant board or institute, not by us.
Analytics output. Sentiment scores, market sizing and forecasts are estimates produced from imperfect data using stated assumptions. They are decision support, not fact, and must not be treated as financial, investment, legal or professional advice. You remain responsible for decisions you make using them.
Availability. Except where a signed SLA states otherwise, the Subscriptions are provided "as is" and "as available". We do not warrant uninterrupted or error-free operation, and we may perform maintenance with reasonable notice.
Third parties. We are not responsible for outages, policy changes or pricing changes at third-party platforms our work depends on, including search engines, social networks, payment processors and hosting providers.
12. Limitation of liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited — including your non-excludable statutory consumer rights.
Subject to that, our total aggregate liability arising out of or in connection with this agreement is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) INR 10,000. We are not liable for indirect or consequential loss, loss of profit, revenue, goodwill, anticipated savings, business interruption, or loss or corruption of data not caused by our breach.
13. Suspension and termination
We may suspend or terminate access if you materially breach these terms — in particular the licence restrictions in section 5 or the acceptable use rules in section 10 — after giving you notice and, where the breach can be fixed, a reasonable chance to fix it. Serious breaches, such as redistributing paid files, may result in immediate termination without refund.
You may stop using our products at any time and cancel any Subscription. Sections 5, 9, 11, 12 and 14 survive termination.
14. Governing law and disputes
This agreement is governed by the laws of India, and the courts of our registered office's jurisdiction have exclusive jurisdiction — except that if you are a consumer resident in the EU or UK, you keep the protection of the mandatory consumer law of your country of residence and may bring proceedings there.
Before starting proceedings, both sides agree to attempt to resolve the dispute in good faith by writing to the other with the details and allowing 30 days for a response.
15. Changes to these terms
We may update these terms. The version and date at the top always reflect the current text. Changes apply to purchases made after the change takes effect; for Subscriptions we give at least 30 days' notice, and you may cancel before the change applies if you do not accept it.
